A city in Alabama won a ruling in a electronic bingo case but law enforcement officials are appealing.
The city of Ashville, American Legion Post 170 and Shooting Star Entertainment Group went to court to ensure the legality of electronic bingo machines. A judge ruled in their favor on Monday but law enforcement officials want a ruling from the Alabama Supreme Court.
The state has been cracking down on electronic bingo machines under Gov. Bob Riley (R). The Governor's Task Force on Illegal Gambling claims the devices are really slot machines.
A judge ruled against a non-Indian bingo hall in a separate case even after a former National Indian Gaming Commission official testified that seized machines were electronic forms of bingo.
The state's efforts could pose problems for the Poarch Band of Creek Indians, whose gaming facilities exclusively feature Class II machines. Riley has refused to negotiate a Class III compact.
