Mashantucket Tribe to challenge NLRB over union election at casino

The Mashantucket Pequot Tribal Nation of Connecticut will fight the National Labor Relations Board over a union election at its casino.

The tribe disputes the NLRB's jurisdiction on the reservation. "The tribe continues to maintain that federal labor law does not apply," the tribe said in a statement, The New London Day reported.

In 2004, the NLRB overturned decades of precedent and determined that the National Labor Relations Act applies to tribal enterprises. The board said it would look at each situation on a case-by-case basis.

The tribe has enacted a labor law that unions have followed to organize at Foxwoods Resort Casino. The United Food and Commercial Workers asked the NLRB to supervise the election but said it would organize under tribal law
