BIA approves compact for Warm Springs off-reservation casino


The Bureau of Indian Affairs has deemed approved a compact for the Confederated Tribes of the Warm Springs Reservation in Oregon.

The compact authorizes an off-reservation casino for the tribe. It only becomes effective if the gaming site is taken into trust -- the BIA is still reviewing an environmental impact statement for the project.

But the decision is significant because the Bush administration, without tribal consultation or public notice, adopted an internal policy to reject compacts that refer to site that are not yet in trust. The policy was used in 2005 to reject an earlier version of the Warm Springs compact.
