Tohono O'odham Nation casino on hold pending 9th Circuit

The Tohono O'odham Nation of Arizona won't be able to start work on an off-reservation casino until the 9th Circuit Court of Appeals can resolve a legal dispute.

In March, Judge David Campbell ruled that the Bureau of Indian Affairs can place land in trust for the casino. But in a ruling issued on Tuesday, he barred the agency from declaring the land a reservation until the 9th Circuit hears the appeal.

Campbell also barred the city of Glendale from annexing the tribe's land until the 9th Circuit resolves the case. A new state law allows annexation without tribal consent.

The tribe owns a total of 134 acres near Glendale. The city claimed it annexed part of the land but the Arizona Court of Appeals ruled against the city on Tuesday.
