Pojoaque
Pueblo in New Mexico hasn't waived its sovereign immunity, the tribe's top attorney said in response to a lawsuit filed by a former gaming partner.
The tribe is being sued in federal court by The Fine Point
Group. But general counsel Frank Demolli, who is named as a defendant, said the company agreed to resolve disputes in tribal court.
"There was no waiver of sovereign immunity in the contract" between the tribe and The Fine Point Group, Demolli told The Santa Fe New Mexican.
The company doesn't have to address the immunity issue because it is suing individuals like Gov. George Rivera and Demolli, an attorney for The Fine Point Group said. Documents about the case are available at www.thefinepointgroup.com/buffalothunder.aspx.
