Supreme Court considers petition in Bay Mills gaming litigation

The U.S. Supreme Court is taking up a petition in Michigan v. Bay Mills Indian Community, a gaming case.

Michigan Attorney General Bill Schuette sued the Bay Mills Indian Community for opening an casino on a recently acquired site. A federal judge ordered the facility to be closed but the 6th Circuit Court of Appeals lifted the injunction in a decision on August 15, 2012.

The tribe has not reopened the casino but Schuette wants the Supreme Court to review the decision. He argues that the tribe violated the Indian Gaming Regulatory Act and waived its sovereign immunity.

The petition is being considered at a closed-door conference today. The Supreme Court will announce whether it will take the case in an order list next week.
