Non-Indian firm asks court to force casino bids in Massachusetts

A non-Indian developer is asking a federal judge to force the Massachusetts Gaming Commission to open the casino bidding process.

K.G. Urban Enterprises wants to bid on a casino in southeastern Massachusetts. The firm says restricting bids to "a federally recognized tribe" violates the U.S. Constitution because it is "race based."

The commission is considering opening up the region to non-Indian firms because the Mashpee Wampanoag Tribe is facing delays in its bid for the casino. A decision could come this spring.
