Tohono O'odham Nation awaits decision in casino litigation



The Tohono O'odham Nation of Arizona awaits another ruling in a lawsuit that challenges its proposed off-reservation casino.

The state of Arizona, the Salt River Pima-Maricopa Indian Community and the Gila River Indian Community claim the Tohono O'odham Nation agreed not to pursue a casino in the metro Phoenix area even though such language isn't explicit in the Class III gaming compact. A decision is likely to lead to yet another trip to the 9th Circuit Court of Appeals, which has issued two rulings on other matters in the case.

The tribe wants to build the West Valley Resort on land near Phoenix.
