Flandreau Santee Sioux Tribe could lose casino's liquor license

The Flandreau Santee Sioux Tribe of South Dakota could lose a license to sell liquor at its casino unless a federal judge takes action.

The license for the Royal River Casino is due to expire December 13. The state has refused to renew it because the tribe won't collect a tax on sales to non-Indians.

The tribe filed a lawsuit in federal court on Tuesday to prevent the loss of the license. The complaint in Flandreau Santee Sioux Tribe v. Gerlach argues that nothing in the Class III gaming compact or the Indian Gaming Regulatory Act authorizes the tax.

A hearing on the tribe's request for a preliminary injunction is set for December 1.
