Kansas barred from taxing Winnebago Tribe

The state of Kansas hasn't decided whether to appeal a decision that bars the collection of taxes from the Winnebago Tribe of Nebraska.

The state claimed Ho-Chunk Inc., the tribe's economic development corporation, owned more than $1.2 million in taxes for distributing fuel to tribes in Kansas. But the Kansas Supreme Court ruled that HCI didn't meet the definition of a "distributor of first receipt" in the state.

The case, if appealed, could go the U.S. Supreme Court. The justices, in a related dispute, allowed the state to impose a tax on gasoline sold by the Prairie Band Potawatomi Nation in Kansas.

HCI owns Indianz.Com and its sister e-commerce site, AllNative.Com.
