Suit planned over reservation taxes in New York

New York Gov. Eliot Spitzer (D) is facing a lawsuit over tobacco and gasoline taxes on reservation businesses.

When he was running for governor, Spitzer said he would enforce a state law that requires taxes on the sale of goods to non-Indians. But a state assemblyman and a convenience store owner say he isn't following the law.

New York Association of Convenience Stores claims the state loses out on $500 million in tax revenues from reservations. Tribes say they have a right to sell goods without state interference.
