Shinnecock man fights state fishing citations
A member of the Shinnecock Nation says the state of New York can't interfere with his fishing rights.

Gerrod T. Smith was cited for taking flounder and porgies out of season. But he points to an 1659 deed that promised the Shinnecocke "shall keepe our privilege of fishing, fowling, or gathering of berries or any other thing for our use."

Smith was cited in state court but is seeking to have his case transferred to federal court. The tribe's recognition petition is pending at the Bureau of Indian Affairs.
