An appellate court in New York will hear a dispute today over tax-free cigarettes sold by the Cayuga Nation.

The tribe operates two smoke shops on its ancestral reservation. The land, however, isn't held in trust so two counties asserted jurisdiction and shut down the facilities last year.

The tribe wants to keep selling cigarettes without collecting state taxes. The tribe says its reservation was never diminished.
