An appellate division court in New York will hold a hearing on Monday in the ongoing Cayuga Nation tobacco taxation case. The appellate division ruled that Cayuga and Seneca counties were wrong to raid two tribal smoke shops. The upcoming hearing will determine whether the counties' appeal will go to the New York Court of Appeals, the state's highest court, an attorney said. The tribe intends to sue the counties for seizing 17,600 cartons of cigarettes worth more than $500,000. A judge has refused to return the cigarettes while the appeal is pending. Get the Story:
