A federal judge last month dismissed a lawsuit that sought the remains of Apache warrior Geronimo.

Geronimo was buried in Fort Sill, in Oklahoma, and some of his descendants want him reburied in New Mexico, where he was born and raised. But Judge Richard Roberts said the plaintiffs failed to state a claim.

Roberts further stated that federal government, as a defendant, did not consent to the lawsuit. He said the Native American Graves Protection and Repatriation Act "provides for a private right of action" but "does not provide a waiver of sovereign immunity."

The Fort Sill Apache Tribe of Oklahoma opposes the removal of Geronimo's remains.
