Deadline approaches for tribal gas tax refund in North Dakota

Members of the Turtle Mountain Band of Chippewa Indians have until June 30 to submit requests for a gasoline tax refund in North Dakota.

The courts have ruled that the state cannot tax the sale of gasoline to tribal members in Indian Country. So Turtle Mountain members are eligible for a refund of 23 cents per gallon for gasoline or non-dyed diesel purchased on their reservation through August of 2010.

Members of the Mandan, Hidatsa and Arikara Nation, the Standing Rock Sioux Tribe and the Spirit Lake Dakotah Nation are not eligible because their tribes have signed tax compacts with the state.
