7th Circuit blocks village from imposing fees on Oneida Nation

The 7th Circuit Court of Appeals has sided with the Oneida Nation of Wisconsin in a dispute over fees imposed on trust land.

The court ruled that the village of Hobart cannot impose stormwater management fees on the tribe. The decision said the fees were an impermissible tax.

"Because federal law forbids states and local authorities to tax Indian lands, the tribe can’t be forced to pay the assessment decreed by the challenged ordinance if the assessment is a tax," Judge Richard Posner wrote in the unanimous ruling.
