Judge handling smoke shop case new to bench

The federal judge handling the Narragansett smoke shop case is new to the bench, having been appointed by President Bush in July 2002 and confirmed November 2002.

That puts the pressure on Judge William E. Smith, observers say. A former aide to Sen. Lincoln Chafee, his decision will almost certainly be appealed.

"This is one that could go all the way to the U.S. Supreme Court," a tribal spokesperson says.

Smith has set an expedited briefing schedule for the case. A ruling come sometime in October.
