The city council in Auburn, New York, voted 3-2 to approve a partnership with the Seneca-Cayuga Tribe of Oklahoma.
The tribe has ancestral ties to New York. But its land claim was recently killed by the federal courts.
Chief Paul Spicer is pursuing a casino anyway. Before the vote, he presented the plan to the city council to build a large casino resort in Auburn.
The city agreed to host the casino pending state and federal approval and the submission of additional studies. The Cayuga Nation, a co-plaintiff in the dismissed lawsuit, says it will fight the proposal.
