The 8th Circuit Court of Appeals on Tuesday rejected a lawsuit that accused a police officer for the Cheyenne River Sioux Tribe of negligence.

In a unanimous decision, a three-judge panel said Marques Good Low shared the blame for injuries he suffered during a September 1999 incident on the reservation. The court noted that Good Low, who was 18 at the time, had been at a party where he consumed a lot of alcohol before leading police on a chase.

"His own reckless conduct necessitated the presence of law enforcement officers in the alfalfa field and he was equally culpable in causing the injuries he sustained," the decision stated.
