A federal judge has dismissed a lawsuit over a telescope project at the sacred Kitt Peak in Arizona.
The Tohono O'odham Nation filed the case in March, seeking to halt work at the peak.
Since then, the National Science Foundation has agreed to redo all environmental, cultural and historical studies and work with the tribe on the $13 million project.
The tribe said the judge's decision this week won't affect the pending studies. The tribe owns the land on which the telescopes will be placed but has a perpetual lease with the NSF.
