Oklahoma tribal retailers subject to new tax rule


The Oklahoma Tax Commission voted Tuesday to adopt a new rule for tribal retailers who sell tobacco.

The emergency rule [PDF: Announcement] applies to retailers who are licensed by tribes with state tax compacts. It seeks to crack down on the sale of low-tax cigarettes, a practice that the state contends violates the compacts.

The Osage Nation spoke against the rule, the Associated Press reported. The tribe filed a lawsuit against another tax rule that went into effect last month.
