Judge in Colorado weighs placement of Navajo Nation child

A judge in Colorado is considering the status of a child who is eligible for citizenship in the Navajo Nation.

The child's Navajo grandparents are seeking custody. But the Alamosa County Department of Social Services instead proposed to keep the baby in a non-Navajo foster home and to grant visitation rights to the grandparents.

Judge Pattie Swift did not rule on the visitation plan. She said she wants to hear from the grandparents, who were not present in court.

Last month, Swift refused to transfer the case under the Indian Child Welfare Act to the Navajo Nation. She said it was too late in the proceedings toe tribal court.

The child has been in foster care for a little over a year.
