Moapa Band files lawsuit over EPA standards at coal fired plant

The Moapa Band of Paiute Indians in Nevada is suing the Environmental Protection Agency over pollution standards that affect a coal-fired power plant next to the reservation.

NV Energy's coal-fired Reid Gardner power plant contributes to health problems on the reservation, the tribe says. But the EPA has done nothing to address the issue, according to the lawsuit.

“The Moapa Paiutes and Sierra Club have maintained that retirement and transition to cleaner sources is the wise path for Reid Gardner given its old age and high costs,” Chairman William Anderson said in a press release, The Las Vegas Sun reported.

The Sierra Club and the National Parks Conservation Association are part of the lawsuit. It was filed with the 9th Circuit Court of Appeals to challenge an EPA rule that was promulgated in August, the Associated Press reported.
