The U.S. Supreme Court on Monday agreed to consider whether the use of race in public school assignments is constitutional.

The court accepted two cases, one from Seattle, Washington, and the other from Louisville, Kentucky. White parents in two cities say their school districts violate the constitution by deciding where to assign students based on race and other factors.

In each case, the lower courts ruled the system was legal. The Supreme Court, as recently as 2003, ruled that colleges can use race as a factor in student admissions.

White parents say their situation is different because the school districts have set percentage requirements on minority student assignments.
