Osage Nation wins arbitration request for tobacco tax


A federal judge in Oklahoma sided with the Osage Nation and ordered the state into arbitration over the state's tobacco tax.

The tribe is trying to stop the state from enforcing emergency rules on tribal retailers. The state contends some tribes are circumventing the tobacco tax.

A three-member arbitration panel should settle the dispute, U.S. District Judge Terence Kern said. But Kern also said he has the authority to rule on the matter himself at a later date if necessary.
