Aquash murder defendant opposes early trial
A man accused of murdering American Indian Movement activist Anna Mae Pictou Aquash doesn't want his trial moved up.

Richard Marshall, a member of the Oglala Sioux Tribe, was supposed to go to trial in February 2009. But the U.S. Attorney's Office in South Dakota wants him to be tried in December, at the same time as John Graham, another defendant in the case.

Prosecutors want a joint trial because they are linking Graham, who is Tshimshian from Canada, to Marshall. Graham is not a member of a U.S.-recognized tribe and says he can't be tried in federal court because he is not an "Indian."
