NIGA passes resolution against pro-union legislation


At its annual meeting last week, the National Indian Gaming Association passed a resolution against a pro-union bill, Indian Country Today reports.

Tribal leaders believe the Employee Free Choice Act [H.R.1409 | S.560] will infringe on their sovereignty. The bill makes it easier for unions to organize at businesses.

The National Labor Relations Act does not exempt tribal enterprises, according to the National Labor Relations Board. So in some conditions, the EFCA would apply on reservations.

“Tribes are recognized in the Constitution as governments; tribes should be recognized in the statutes as governments,” NIGA executive director Mark Van Norman, a member of the Cheyenne River Sioux Tribe, told ICT. “We’re going to devote a lot of time and energy to securing the treatment of tribes as governments under EFCA and the NLRA.”
