"The Oglala Sioux Tribe claims four beer stores in a small Nebraska town that collectively sell nearly 5 million cans of beer a year have created a public nuisance on its South Dakota reservation. The claim also extends to the stores' beer suppliers.

The tribe's attorney, former state senator Tom White of Omaha, amended a lawsuit March 23 that was filed in U.S. District Court in Lincoln on Feb. 9. The amendment claims alcohol sales in Whiteclay have led to public intoxication, drunken driving and crimes committed by intoxicated people on the Pine Ridge Indian Reservation.

"The actions of the defendants as previously alleged have interfered with the use and enjoyment of (tribal) land including, but not limited to, the ability to develop and enhance the value of that land," the amendment states. "As a result, the value of the land owned by the OST is depressed due to the illegal unreasonable conditions created by the defendants.""
