ADVANCE: Land-into-trust regs

The Department of Interior has proposed to withdraw a set of land-into-trust regulations tribal leaders urged her to accept.

The Interior will be seeking comments on the withdrawal, thereby delaying the effective date of the regulations. A Federal Register notice to be published on Monday will announce her decision.

According to the document, which was signed by Assistant Secretary Neal McCaleb, the Interior is seeking to withdraw the rule because "it may be impracticable and inefficient to repeal only part of the final rule."

A number of tribal leaders and the National Congress of American Indians worked with the Bureau of Indian Affairs to solidify with the rules. They define a set of criteria the government will use to take land into trust for tribes.

Although tribal leaders were not completely satifisfied with the rules, they had pressed the Bush administration to keep them. Some states and local communities believed the rules were too lax.

In April, Secretary Norton delayed the regulations by 60 days, seeking comment to amend in whole or in part or withdraw in whole or in part. The department then took another 60 days to review the comments.

The Interior received 192 sets of comments.
