New York court won't rehear gaming challenge

The New York Court of Appeals on Wednesday refused to hear a challenge to the expansion of gaming in the state.

In the wake of the September 11, 2001, terrorist attacks, state lawmakers authorized six tribal casinos and video lottery terminals at racetracks. Opponents challenged the expansion in court but lost.

Of the casinos, three were reserved for the Seneca Nation. The tribe has opened one off-reservation casino and has plans for another off-reservation casino. The tribe also has an on-reservation casino.

The other three casinos are to be located in the Catskills. No tribe has gained approval to open an off-reservation casino there. The St. Regis Mohawk Tribe, whose reservation is hundreds of miles away, is the farthest along in the review process.
