Officials in Amador County, California, are challenging the Indian lands determination for the Ione Band of Miwok Indians.

The county says the tribe doesn't qualify as "restored" under the Indian Gaming Regulatory Act. So a 228-acre site can't be used for gaming, according to the appeal filed with the Interior Board of Indian Appeals.

Interior associate solicitor Carl Artman, who is the nominee to head the Bureau of Indian Affairs, said the tribe qualifies for an exception under Section 20 of IGRA. He said the tribe lost its recognition, which was later restored.
