The Lower Brule Sioux Tribe of South Dakota expects to submit its off-reservation casino application to the Bureau of Indian Affairs next month, a developer said.

The tribe wants to build a $34 million casino on a 91-acre site that was taken into trust after 1988. The application will be processed under the two-part determination provisions of the Indian Gaming Regulatory Act, meaning the state governor's approval will be required.

"This isn’t something we’re trying to jam down anyone’s throat at the last moment. We’re at the beginning stages," developer Richard Rangel said at a meeting where the casino plan was unveiled, The Chamberlain Sun reported.

Since 1988, only three tribes have successfully opened casinos under the two-part determination process. Two additional tribes, both in California, completed both steps last year but their projects are being challenged in court.
