The Obama administration is asking a federal judge to dismiss a lawsuit filed by the Wyandotte Nation of Oklahoma.

The tribe sued the Bureau of Indian Affairs for failing to take action on its land-into-trust application for a gaming site in Kansas. But now that Assistant Secretary Kevin Washburn rejected the application in a July 3 decision, government attorneys say the case should be dismissed.

The tribe has said it will fight the decision.
