Cobell plaintiffs disputing trust fund rider

An appropriations rider that delays a court-ordered accounting of the Indian trust fund is unconstitutional, attorneys for the Cobell plaintiffs are arguing.
The attorneys are filing briefs in district court and appeals court in Washington, D.C., in response to a stay sought by the Bush administration.
They say Congress can't tell courts how to interpret existing law.
The D.C. Circuit Court of Appeals has delayed the case while it reviews the issue.
