Oneida Nation eviction case heads to Supreme Court

Members of the Oneida Nation who are facing eviction from their New York reservation are taking their case to the U.S. Supreme Court.

The families had asked the 2nd Circuit Court of Appeals to stop the eviction. They say they are being singled out for opposing the tribal leadership.

But the appeals court declined to get involved in the internal dispute. A lawyer for the families, though, said the court has ordered the tribe not to proceed with the evictions pending further action.

The case is based on the Indian Civil Rights Act. The Supreme Court has not accepted an ICRA case since 1978, when it decided Santa Clara Pueblo v. Martinez.
