Federal judge in Everglades case disqualified
Wednesday, September 24, 2003

The federal judge presiding over the Everglades cleanup case was disqualified on Tuesday for appearing biased against the state and the sugar industry.

U.S. District Judge William Hoeveler, a widely respected jurist, was kicked off the case by Chief U.S. District Judge William Zloch. Ruling on a motion filed by the sugary industry, Zloch said comments Hoeveler made "demonstrate an objective doubt" about his impartiality.

Hoeveler has sided with the Miccosukee Tribe and environmentalists in parts of the case. He has been critical of actions the state has taken to cleanup the Everglades.

Orders in the case can be found at http://www.flsd.uscourts.gov/default.asp?file=cases/index.html
