Lawsuit questions state's approval of off-reservation casino

A lawsuit questions whether California Gov. Jerry Brown (D) had the ability to approve an off-reservation casino for the North Fork Rancheria of Mono Indians.

Brown approved the casino under the two-part determination provisions of the Indian Gaming Regulatory Act. He also signed a Class III gaming compact with the tribe.

The lawsuit, however, claims the state constitution doesn't authorize a governor's concurrence for an off-reservation casino. This is the first time the issue has come up in California.

The lawsuit was filed by Stand Up for California and a local resident. A decision could come later this year, The Fresno Bee reported.
