Narragansett man appeals verdict in raid case

A member of the

Tribe is asking the
1st Circuit Court of
Appeals to hear his excessive force case against a Rhode Island state trooper.
Adam Jennings was at the tribe's smokeshop when it was raided by the state on July 14, 2005. His ankle was broken by trooper Kenneth Jones.
Last month, a federal jury said Jones did not use excessive force against Jennings. That was a different outcome than the first trial, in which Jennings won a $301,000 award that was upheld by the 1st Circuit in March 2007.
The judge who handled the case then granted a motion for a retrial, which was held in July under a different judge.
