Miccosukee Tribe gets day before Supreme Court

The Miccosukee Tribe will ask the U.S. Supreme Court on Wednesday to prevent its homelands from being polluted by water managers in Florida.

The South Florida Water Management District owns and operates a pumping station that pumps dirty water into the Everglades. The tribe says the pollution has destroyed fish, wildlife and the environment.

The district doesn't deny moving the water around. But it says it is not creating new pollution and shouldn't be forced to comply with the requirements of the federal Clean Water Act.

Along with an environmental group, the tribe won two rulings affirming its stance. The water district, with the backing of the Bush administration, says the decisions should be overturned.

The National Congress of American Indians (NCAI) submitted an amicus brief in support of the tribe.
